New fireworks regulations

In February, the Town Council adopted Ordinance 2014-12, which creates regulations for the use of consumer fireworks in Whiteland. This ordinance was the culmination of several months of work between the Council, residents, and police and fire chiefs. A primary goal was to form regulations that restrict the excessive fireworks nuisance while not impacting their reasonable use.

fireworksbrochurecoverMajor aspects of the regulations include where fireworks can be used, when, how often, and what the penalties are for exceeding the restrictions. These points are summarized in this handy reference brochure, and a brief list is below.

The brochure is available for download now, and hard copies will soon be available at Town Hall, the Police Department, and Fire Department. It is also planned to have them available at each fireworks store in town as those stores open in May and June.

Location

Fireworks must be used on property you own or have permission to use, or at specially fireworks areas designated by the Fire Department. The property owner is responsible for fireworks used on their property.

Fireworks cannot be used on others’ property without permission, on Town-owned property without authorization of the Council, or on public streets.

Times

For most of the year, fireworks can be used from 10AM to 11PM, but there are some extended hours around the Fourth of July and New Year’s Eve holidays.

Frequency

During times they are permitted, fireworks generally cannot be shot off in three or more hours times of a day, nor on more than three days in a week.

Enforcement

Fireworks usage in excess of these local regulations can result in escalating fines of $25-500 per violation.
